Marine Parks Compensation

Section 21 of the Marine Parks Act 2007 provides that the Minister must pay fair and reasonable compensation to holders of statutory authorisations if the rights conferred by their authorisations are affected by the creation of a zone or the imposition of a temporary prohibition or restriction of activities in a marine park.

This means that holders of fishing licences under the Fisheries Management Act 2007 that have been adversely affected by the creation of a marine park sanctuary zone can apply for compensation under the Marine Parks Act 2007.

The Marine Parks (Statutory Authorisation Compensation) Regulations 2015 establish a process for applying for compensation.

Making an application for compensation must be in accordance with Section 21 of the Marine Parks Act 2007 and the Marine Parks (Statutory Authorisation Compensation) Regulations 2015. The application must include all relevant information required to support the claim.
